So in summary it appears that;
- a significant failure has a low probability assuming a reputable tuner is involved and strict maintenance is adhered to
- should a significant failure occurs it is far from certain there would be an investigation and even if there was the warranty may not be denied depending on the results of the depth of the investigation
- you have to be able to afford the consequences if the warranty is voided and that could be in excess of $5k . If you can't afford it then don't tune
Therefore, it becomes a question do you want to drive a sub-performing car for the initial 5 years or risk a ~$5k loss?

Well, I assume that you are pricing in a new Ford shortblock at $5kish? That is not installed.
Used is certainly available. The car is only sub performing in your mind- as it performs as targeted and released from the manufacturer.
You can invest your money in various ways. Generally the greater the risk the greater returns are possible. Also possible to lose a bunch, hence the risk. There is no free lunch anywhere ever.

Very true.

I'm leaning towards a tune based on what appears to be the lower risk of a catastrophic failure occurring as being an outlier. By sub-performing I mean not up to its potential based on this lower risk.

I understand what you meant. It's a struggle to get exactly what you want vs appreciating what it already is. We all have to contend with this. I really want to buy a newer SHO and tune it. I really don't feel like contending with the shortcomings of the powerplant and drivetrain design weaknesses. So far I have managed to not buy one yet. so far..

Do you mean the PTU for the drivetrain? What are the shortcomings of the engine?

Water pump/timing chain are a big ones. Also turbo failure. Religious maintenance/high quality fluids help in those areas
