20 bucks says its the 02 sensor, could they check it out when it was there the last time? nope, they had to schedule me for a totally different day

i havent even had my car for a full week since i got it

failed emissions huh? i love not having to pass those things i could be running the most vile car with out cats and still be legal. can't u just replace the o2's?, thats if it is them hows ur gas mileage been? if crappy most likely them.

What part of the test did it fail?

If your NOx levels are too high, you should probably read through this recent thread:

Unless you specifically asked them to check emissions or the O2 sensors, you have no basis for being upset with the dealer.

For all we know, you asked them to change the oil.
