Stock files are available (for purchase/loading) and strategy codes are not often specific to an individual vehicle, but rather a bank, or grouping of vehicles.

My biggest concern in reading through this, is the fact that the previous owner has (what is believed, or reported to be) a working key to the current owner's car.

That's a big no no, and the fact it was kept, and now this previous owner monitored the sale of the car, and reached out to the current owner immediately after purchase, is a tad bit disconcerting.

I would be HIGHLY SUSPICIOUS of any/all of this personally.

i did reach back out to the guy this afternoon asked if i could buy the device from him no response as of yet.not sure what if any recourse i have. i know if i ask the dealer to give me new keys fobs it will start a shit show.

Used or not, they still have a responsibility/liability to make sure your car is not susceptible to theft by means of an unaccounted for key fob.

As far as it having a tune on it though, I am fairly certain that if it was marked "Used / As-Is" then you'll be out of luck on that front.

But the key issue is a big no no. Least in my State it is.

I don't know about where you live, but around here you can go to the police station for local sales. Things like craigslist etc. I would definitely suggest doing that with this person. If they won't meet at a police station then something is definitely wrong.

For the key thing, you can buy a new lock cylinder set if you want.

If you go to the dealership, or maybe a locksmith, you can erase your current PATS keys, then reprogram them. This will erase any previous remembers keys. So although the previous owner. An unlock your car with the cylinder, he or she cant start it.

For the keyless entry key code number to be reset, a new BCM will have to be installed.

Two comments: Why on God's green earth would anyone sell or trade a car without first returning it to stock so they could use the tuning device on another vehicle? The key thing is bad enough but I would absolutely NOT want a tuned car that I couldn't return to stock when and if I wanted to.

He kept the key fob to steal it later... and left the tune so he could drive away faster.

Personally I think the past three comments are precisely necessary.

I would be very weary that someone out there has a working key to my vehicle and that they are in the area. I would also not be trading in a tuned vehicle to a dealership. It would put it back to stock, so that I could use the device on another vehicle if it was compatible. If it wasn't then I would sell it.

However, if it was private party I would keep the tune in the car and explain to the interested part that the vehicle is tuned, and that the tuner is part of the deal. I would also had over all documentation, keys, and stock parts that go with the vehicle.

I would also be very weary that the previous owner wants to unmarry a device from a vehicle he knowingly and willing traded in.

If he made contact with you, then he should in good intentions be willing to give you the key ASAP.....period. This is now day three or four and you still yet to have the key?

I would be heading to the dealership today, with the message, and asking if they would be able to re-program the car and keys for my piece of mind.

It's entirely possible the dealer deleted the key fob if they programmed additional keys. The physical key is a different story. I believe you can see how many keys are programmed through forscan.
i bought it CPO
You may end up with issues with the car tuned, no way to return to stock, and Ford honoring the CPO warranty for certain things, read expensive drive train repairs.

I think we've given you plenty of advise, I personally took the time to explain, gave you my opinion on what to do and shared my buying experience as a reference.
Not sure what else is left to say so what's wrong with having a bit of fun.

Here's more. Verify that the missing key fob has been erased and get the dealer to respond for not disclosing the car was tuned. They should be contacting the PO and get this resolved for you... if you really want your car back to stock.
You should also know that depending on the tune you have, your SHO might need 91 or 93 octane fuel.

I'm pretty sure you can see how many keys are programmed to your car without using forscan. I can't tell you where, but I know I stumbled across it on my car a few days ago while I was goin thru menus. I was surprised to see there were 3 keys programmed to mine. No big deal since I bought it 2.5 hours away, but it's in there somewhere.

thank you ill look into that. i did hear from the previous owner he said he just saw my requests and will answer me asap. so there is some hope of resolving all issues. best advice i got here is to buy the device from him. all your suggestions are greatly appreciated on this most trying matter.

Don't forget to ask if he still has the 2 BAR map sensor and OEM thermostat. Those are garbage for him and you'll need them to return it to stock (depending on the tune you have now).

thanks will do. is it possible to have a stock MAP and thermostat with a tune? and should i ask about the type of plugs?

yes there are tunes for the 2 bar map and stock T stat. I would ask about the plugs, and anything else he has done to the car.
