Just figured guys since he wrote a nasty pos about me and somehow included Fred in it I would give you a status.


The car now has been done for 15 days and not a word from him, we did continue our little discussion off list and he even dragged other members into that. He has been notified several time through voice mail and email about the status of his car with no replys since I told him the car was infact completed.. The cost of his Motor swap was 1000 plus 20.00 per day storage fees after the 2nd day (only chargeing storage because of what he did here recently) now its 13 days storage and the 1000 fee. He has a rental car from Enterprise which im in almost daily contact with them about this and they are in the loop about when the car was done. I just called again a few mins ago and they are sending him a registered letter to return the car and submit all fees due from Jan 15th, also the letter went out a few days and if they do not hear back soon they will be reporting the car stolen. He was incontact with them on last Friday saying that he would be right down with the car, myself and another Member have been trying to call him since the car was done, so he IS avioding all phone calls and email and hes not dead. I was begining to think something happened to him and thats why he has been playing this game but I know now that he is just not answering his phone. Real Nice Guy!

I realize now that I should have used better judgment reguarding this kid that blasted Fred Months ago for not jumping to attention and dropping his life for this kid.. My bad..

But the good news is that if I dont hear from him very soon explaining why he is a deadbeat and spent all of the money he stole out of the insurance company I will have another 3.2 for sale.

Anyway just a update on this wonderfull EX member.

Unfortunately some people are just Dirt-bags. They'll get what they have comming to them. They always do. Best of luck dealing with this tool. I'm sure you'll resolve it, but its just the hastle noone needs.

I bought a chip off of Ebay from you a while back and your services were excellent! I don't understand why this guy is/was such an idiot and wasn't nicer to you... You were always on the ball with everything. When I ask a question I usually get a timely response from you. This guy is a *****. PERIOD! You gotta love the mechanic's lean!

BTW If that 3.2 goes up for sale, how much would it be? evil_gri

I've tried calling him several times to go get his car at Kirks and he wont answer his phone. We have left several messages.

Now he is claiming that he was in a car accident (very bad). and that is the reason why he has not called or contacted anyone. This could be true so we are not holding up the BS flag yet...

If this is indeed true and he shows proof that he was indeed in the hospital I know Kirk is not going to make him pay for storage. But on the other hand, if no proof, 3.2 for sale..........

Accident with the rental car? If so, the rental company should have a record of that. Even if it's not with the rental, if he was in the hospital it's public record. Anyone can access it, but those of us who are associated with certain law enforcement agencies may be able to get information that others cannot.

And yeah, gimme his number, I wanna offer him $200 for his car.

I think something like this falls under defamation of character, so if this guy is really the ******** that he's being made out to be, the forum and vendor are in a actionable position.

It really low to post alot of shit about someone, and deny them the ability to respond. Kinda like putting the last word in cause someone is a moderator then locking the thread.

That being said, I'll throw in a bid for the car cause I'm sure that if kirk worked on it he did more work (then what was "contracted") to make sure it was perfect. I'll go $400

Nope. Smurf proved himself to be an unproductive member, not only spreading falsehoods here on the forum, but also to his insurance company by providing them with Fred's name and phone number and he was in no way involved with his car. His removal was justified and I stand behind my decision. His removal was for no other reason than stated above.

In regards to the forum being liable for statements made. Again, nope.

As seen in our Terms of Service, which can be viewed here it clearly states the following under paragraph 6.

6. LIMITATION OF LIABILITY

In most any other circumstance i would not agree with this kind of thread, but considering how low and how often Smurfboy went in trying to tarnish the name of Fred and kirk, i consider this justified.

Beth - I wasn't trying to imply that the forum was doing anything wrong just wanted to point out that perhaps he could in some way use it against thyou or the forum.

I agree with the decision to remove him I saw most of the comments that flew around here on that one thread, and what he was saying about kirk, fred, ect. I heard about some of the other details circling around this, but on a whole sounds like he was in the wrong for most of what went on.

I really should read the TOS again cause I totally missed that the last time I read it.

So who's gonna bid $401+? **** Kirk should auction the car as a SHOforum benefit auction, taking an amount to cover the work he put in, but then on the block it goes....

On a side note, Have you ever noticed that most TOS' on a site are strewn with words that have underlining meanings? I have a hard time reading stuff like that!(Scratching head greamlin goes here) I guess my racing thoughts(I can't ever think straight because of too many thoughts at once) have something to do with that... shrug

Spoke to him Via email the other day, he sounds sincere. if he has proof of this accident I will not charge him storage (im not a total ****) but the reckless negelect that he has shown I hope others see and learn from this.

The Rental company also spoke to him, he did not mention the accident to them whatsoever, either way he knows that Im away in Nashville and wont be back till the 5th.. Thats when he can proove or pay. Either way this stinks, and makes me want to start getting a deposit from people that I dont know, kind of ruins things for everyone else.

PS,, IMO his car is not great on the outside. Newer motor and trans makes it a good car, but LOTS of other defects.. If you guys want to bid on a nice car look here..
