Anything in excess of the posted limit is considered "illegal" tyvm.
****, even 1MPH over would be considered a violation.
Some choose to push the envelope further than others.
Whether or not that may be me specifically is open to debate.

IIRC, back on the drive to the '01 Convention in OK, Mark Hlady (MN County Mounty) got pulled over with a string of SHO folks doing "well in excess" of the 80 MPH limit. Since he was caught with other civilians, his badge didn't cut him any slack!
